1.      Scope

For all deliveries of SicherSatt AG to consumers and resellers these General Terms and Conditions (AGB) apply.

3.      Offer and conclusion of contract

3.1   The presentation of the products in the online store is not a legally binding offer, but an invitation to order. All offers are valid “while stocks last”. Errors excepted.

3.2   By clicking on the button „Place order” in the last step of the ordering process you place a binding order for the goods contained in the shopping cart. The contract of sale is concluded when we accept your order by means of an order confirmation/invoice by e-mail or fax after receiving your order.

3.3   If within 14 days after our order confirmation/invoice no payment from the buyer is credited to our accounts, the order will be automatically cancelled without further contact. There is then no more claim for delivery. All claims arising from such a contract expire completely and become invalid.

3.4   For orders received in written form, e.g. by letter, fax or e-mail, our general terms and conditions also apply, analogous to orders via our online store.

3.5     By completing the order, you agree that your order data will be passed on to the shipping company, among other things for tracking purposes.

5.        Right of withdrawal

Cancellation policy

You can revoke your contractual declaration within two weeks without giving reasons in writing (e.g. letter, e-mail) or by returning the goods. The period begins at the earliest with receipt of this instruction. The timely dispatch of the revocation or the goods is sufficient to comply with the revocation period. In the event of an effective cancellation, the services received by both parties are to be returned and any benefits derived (e.g. interest) surrendered. If you are unable to return the received goods or services in whole or in part or only in a deteriorated condition, you may be required to pay compensation. This does not apply to the surrender of goods if the deterioration of the goods is exclusively due to their inspection – as it would have been possible for you in a store. In addition, you can avoid the obligation to pay compensation by not using the goods as if they were your property and by refraining from doing anything that could impair their value. Items that can be shipped as a parcel are to be returned. You have to bear the costs of the return shipment if the delivered goods correspond to the ordered goods. You must fulfill obligations to reimburse payments within 10 days after sending your declaration of revocation.

6.        Prices and shipping costs 

6.1  The prices stated on the product pages include the statutory value added tax and other price components.

6.2 The prices are ex stock.

6.3 The shipping costs depend on the quantity of the ordered goods as well as the mode of shipment and will be clearly communicated to you before you place your binding order. In addition, the shipping costs will be shown on the invoice.

7.        Payment

7.4   The payment takes place alternatively by prepayment

  • or at the discretion of SicherSatt AG by invoice.

7.2   For payment by credit card, the Customer must enter the required information about his credit card and the three-digit security code on the back of the credit card, on the signature strip. If the payment is successful, the customer will then receive a confirmation by e-mail with all necessary information about the purchase and the provider.

7.3   You are only entitled to a right of set-off if your counterclaims have been legally established in court or acknowledged by us in writing.

7.4  You may only exercise a right of retention if the claims result from the same contractual relationship.

 

8.        Delivery

8.1  The delivery is ex stock.

8.2 As a rule, delivery will be made immediately after receipt of payment. We point out possible deviating delivery times on the respective product page.

8.3 Should the ordered product not be available in time because we are not supplied with this product by our supplier in time, we will inform you immediately.

9.        Retention of title

The goods remain our property until full payment is received.

10.    Exclusion of liability

10.2 If a product is damaged under the influence of third parties (delivery by mail or courier…..), SicherSatt AG declines any liability.

10.3 If the goods are not stored properly (as described on the respective product page), all liability/guarantee regarding BBD (minimum durability date) is rejected.

11.   Warranty

The warranty is subject to the statutory provisions.

12.    Other

Einzelabsprachen, die von unseren allgemeinen Geschäftsbedingungen abweichen, gelten nur, wenn sie schriftlich niedergelegt und von uns bestätigt wurden.

13.    Place of jurisdiction

The place of jurisdiction for all disputes is Zurich.
